The tribunal will inquire into the allegation that on 9 April 2015 whilst carrying out spinal surgery on Patient A, Dr Mitchener failed to fully assess patient A’s radiological imaging, incorrectly carried out Surgery on Patient A’s spinal column, and failed to perform X-rays at the end of Surgery A to ensure that the correct operative level had been operated on. It is also alleged that at the post-operative review appointment of Patient A on 22 May 2015, Dr Mitchener failed to recognise that Surgery A had been carried out at the incorrect operative level.

It is also alleged that at a review appointment with Patient A on 5 October 2015 Dr Mitchener knew that Surgery A had occurred at the wrong site. It is alleged that on 6 April 2016 Dr Mitchener discussed Surgery A with Patient A and suggested a figure of £10,000 as compensation for operating on the wrong site and failed to record the discussion in Patient A’s notes. It is alleged that in so doing Dr Mitchener’s actions were dishonest.

It is also alleged that on 23 March 2017 Dr Mitchener failed to ensure that Patient B’s radiological imaging scans were available for spinal surgery and also failed to reconcile Patient B’s details on the radiological imaging scans before Patient B was anaesthetised.




This reflects the allegation as it stands at the start of the hearing. The allegation may be amended as the hearing proceeds and when findings of fact are made by the tribunal.
