Pre hearing information


The tribunal will inquire into the allegation that, between 2006 and 2010, Dr Cunliffe was employed at the Heart of England NHS Foundation Trust as the Acting Medical Director for Surgical Services (from April 2006 to September 2007); Medical Director for Surgical Service (from September 2007 to June 2009); and Medical Director (from June 2009 to September 2010). It is alleged that between 1 June and 31 August 2007, Dr Cunliffe failed to protect patients from the harm posed by Mr A’s breast surgical practice.

It is also alleged that on 15 October 2007, in response to the GMC’s request for information, Dr Cunliffe failed to disclose clinical concerns raised about Mr A’s breast surgical practice from June 2007 onwards, or the ongoing investigation.

It is further alleged that in July 2009, following the implementation of a protocol to identify patients who had undergone a cleavage sparing mastectomy or subtotal mastectomy, Dr Cunliffe failed to protect patients from the risk of harm posed by Mr A’s breast surgical practice, in that he allowed Mr A to review and refer patients himself under the protocol.
