Pre hearing information
The tribunal will inquire into the allegation that, in September and October 2018, Dr Patel sent text messages to Mr A regarding a national cosmetic expo show and the marketing of an anatomical ‘breast model’ (the Model), which were untrue. It is also alleged that in November 2018 Dr Patel sent an email to Mr B, regarding the Model, containing information which was untrue.
It is alleged that Dr Patel’s actions, in respect of Mr A and Mr B, were intended to intimidate the recipients and to dissuade them from protecting their intellectual property rights in the Model. Furthermore, it is alleged that Dr Patel’s actions were dishonest.
This reflects the allegation as it stands at the start of the hearing. The allegation may be amended as the hearing proceeds and when findings of fact are made by the tribunal.
