Pre hearing information

The Tribunal will enquire into the allegation that, on 29 January 2016, Dr Winston performed an extraction of the wrong tooth on Patient A without consent. It is alleged that, following the procedure, Dr Winston failed to record his errors appropriately, failed to inform Patient A that he had extracted the wrong tooth, and acted dishonestly.

It is further alleged that Dr Winston sent inappropriate text messages to a colleague, Colleague B, on three occasions in January and February 2016. It is alleged that Dr Winston sent Colleague B a further inappropriate message on 6 February 2016, despite being warned by the Trust not to do so.

It is alleged that, by reason of the matters set out above, Dr Winston’s fitness to practice is impaired by reason of misconduct.

This reflects the allegation as it stands at the start of the hearing. The allegation may be amended as the hearing proceeds and when findings of fact are made by the tribunal.

All decisions are published online within 28 days of the conclusion of the hearing.
