Pre hearing information
The tribunal will inquire into the allegation that on 29 June 2018 NHS Tayside imposed restrictions in relation to hand and wrist surgery on Dr Thomas’ practice. It is alleged that Dr Thomas failed to notify NHS Tayside that he practised privately at BMI Kings Park and BMI Fernbrae Hospital, which meant that these Hospitals were not notified about the restrictions by NHS Tayside. It is alleged that Dr Thomas failed to comply with the restrictions and undertook a number of restricted procedures between 10 August 2018 and 3 December 2018.
It is also alleged that on two separate occasions in August 2018 Dr Thomas told two colleagues, Dr A and Professor B, that he could not attend meetings because he had appointments with his General Practitioner and / or had to pick up a family member. It is alleged that Dr Thomas knew that he did not have GP appointments and knew that he was working at Fernbrae Hospital.
It is further alleged that on four occasions in April 2019 Dr Thomas carried out clinics at Kings Park whilst he was on paid sick leave from NHS and on one occasion whilst he was suspended from practising and being paid by NHS Tayside, when he knew he ought not to have done so.
It is alleged that Dr Thomas’ actions were dishonest.
This reflects the allegation as it stands at the start of the hearing. The allegation may be amended as the hearing proceeds and when findings of fact are made by the tribunal.
