Pre hearing information
The tribunal found that, on or around 15 November 2018, Dr Foy-Yamah treated Ms A, a person with whom he had a close personal relationship and arranged for Ms A’s blood to be tested urgently for the Human Immunodeficiency Virus (HIV) when it was not clinically indicated and failed to document the reason for the test, or that it had been requested in Ms A’s medical notes. In addition, the tribunal found that Dr Foy-Yamah failed to notify Ms A’s general practitioner and infectious diseases team of the result of the test.
The tribunal also found that on or around 2 or 3 December 2018, Dr Foy-Yamah had sexual intercourse with Ms A without her consent, or a reasonable belief that she had consented, and his conduct was sexually motivated.
The tribunal will reconvene to determine whether Dr Foy-Yamah’s fitness to practise is currently impaired by reason of misconduct.
This reflects the allegation as it stands at the start of the hearing. The allegation may be amended as the hearing proceeds and when findings of fact are made by the tribunal.
