Allegation

The tribunal will continue to inquire into the allegation that, in or around December 2012 to January 2013 and in November 2019, Dr Smerdon behaved in a sexually motivated way towards Patients A and B respectively when he knew that both patients were vulnerable by reason of their mental health.

It is alleged that Dr Smerdon’s actions towards Patients A and B were carried out with the intention of pursuing a sexual relationship. It is further alleged that in the case of Patient A, Dr Smerdon’s actions were controlling and manipulative and in the case of Patient B, Dr Smerdon’s actions were carried out without their consent and constituted sexual harassment.
