Legislation
Our functions and the way we carry those out are set out in law. Here we give details of the main legislation that governs our work.
The Medical Act 1983
The Medical Act 1983 is the legal basis for everything we do. It sets out the powers and responsibilities of our tribunals.
The GMC Fitness to Practise Rules
The GMC Fitness to Practise Rules 2004 set the more detailed arrangements of how our tribunals work.
Restoration
Legislation for doctors restoring their name to medical register:
- GMC (Voluntary Erasure and Restoration following Voluntary Erasure) regulations
- GMC (Restoration following Administrative Erasure) regulations
Tribunals
The arrangements for the composition of our tribunals are set out in statutory rules. View the General Medical Council (Constitution of Panels, Tribunals and Investigation Committee) Rules Order of Council 2015.
Legal assessors
Legal assessors sometimes sit with our tribunals and advise them on points of law. In most hearings a legally qualified chair will advise the tribunal. View the General Medical Council (Legal Assessors and Legally Qualified Persons) Rules Order of Council 2015.
