Joinder
- When allegations have been referred to an AT for a hearing, either party may apply for:
- two or more allegations against the same PA or AA, or
- allegations against two or more PA or AAs
to be considered and determined together at the same hearing.8
- Joinder applications are identified during the pre-hearing case management stage, with applications being made by one or both of the parties. The application will be decided by an MPTS case manager and the associates tribunal (AT) will be supplied with a copy of the pre-hearing decision.
- By exception, an AT may need to consider a joinder application where it has not been possible for the issue to be resolved by an MPTS case manager in advance. If this arises, the AT should refer to the guidance for decision makers, parties and their representatives on the Joinder of allegations which sets out the factors to consider when deciding a joinder application.
