Joinder

  1. Joinder applications are usually identified and decided during the pre-hearing case management stage. By exception, an associates tribunal (AT) may need to consider a joinder application where it has not been possible for the issue to be resolved by an MPTS case manager in advance. If this arises, the AT should refer to the guidance for decision makers, parties and their representatives on the Joinder of allegations which sets out the factors to consider when deciding a joinder application.
